In Iowa, the mini-FTC act is Iowa Code § 714.16. Under this legislation, the State Attorney General has a cause of action against a person who engages in a variety of unfair practices, deception, fraud, false pretense, false promise, or misrepresentation, or the concealment, suppression, or omission of a material fact with intent that others rely upon the concealment, suppression, or omission, whether or not a person has in fact been misled, deceived, or damaged. If found guilty, a person is subject to damages and injunctions, as well as fines not to exceed $40,000 per violation.
