In Georgia, the mini-FTC act is Ga. Code Ann. § 10-1-390 to 407. Under this legislation, a plaintiff has a cause of action against a person who engages in a variety of unfair and deceptive practices while conducting a trade or business. Violators are subject to injunctions, general and exemplary damages. Actions must be brought within two years of the time when the person bringing the action knew or should have known of the violation, or within two years of the termination of any State action, whichever is later. Actions must be brought individually, not in a representative capacity.
