In Arkansas, the mini-FTC act is ARK. CODE ANN. § 4-88-102 to 108. Under this legislation, the State Attorney General has a cause of action for a variety of deceptive and unconscionable practices. There is a five-year statute of limitations after the violation has occurred. The Attorney General can pursue injunctive relief, $10,000 fine per violation, as well as restitution damages. Further, elderly or disable persons, as defined by the act, can initiate a private right of action against violators. They can recover actual and punitive damages, as well as reasonable attorney fees.
