Many common contracts contain clauses that require the buyer to pay for any attorney’s fees that the seller incurs as the result of litigation brought on by the buyer. Payment of seller’s attorney’s fees are commonly required of buyers if they default or breach the contract. The goal is to provide the buyer with an incentive to adhere to the terms of the contract and to protect the buyer from court fees in the event of a buyer’s breach.
